Operator details pending confirmation
Full company name, Companies House number, and registered office will be added to these Terms once confirmed. Legal queries: legal@peekaboohq.com.
1. Agreement to these Terms
These Terms of Service ("Terms") are a contract between you and Peekaboo HQ ("Peekaboo", "we", "us") for use of the Peekaboo childcare management platform, websites, and related services (the "Service").
By creating an account, clicking to accept, or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.
If you use the Service on behalf of a nursery, childminding business, or other organisation, you confirm you have authority to bind that organisation, and "you" includes that organisation.
2. Definitions
- Customer Content: data, text, images, and other materials you (or your authorised users) upload to the Service.
- Provider Account: an account used to operate a childcare setting on Peekaboo.
- Parent User: a person invited by a provider to view or interact with information about their child.
- Subscription: a paid plan governing feature limits and fees.
3. Eligibility
Provider Accounts are for adults (18+) acting as or for a childcare provider. You must provide accurate registration information and keep it up to date. Parent Users must be adults with legitimate authority in relation to the child records they access.
4. The Service
Peekaboo provides tools that may include child records, attendance, staff scheduling (including Smart Rota on eligible plans), billing support, parent communication, and related features described on our website. Features vary by Subscription.
Peekaboo is software. It does not replace professional, legal, safeguarding, or Ofsted advice. You remain responsible for regulatory compliance in your setting, including ratios, record-keeping, and how you use outputs from the Service.
5. Accounts and security
You are responsible for accounts issued to your organisation, for keeping credentials confidential, and for activity under those accounts. Notify us promptly of suspected unauthorised access at hello@peekaboohq.com.
We may suspend access where we reasonably believe there is a security risk, unpaid fees, or a material breach of these Terms.
6. Subscriptions, fees, and cancellation
6.1 Plans and trial
Peekaboo Childminder, Essentials, Professional, and Enterprise are paid Subscriptions with limits and features described on our pricing page. Peekaboo is not yet open for new sign-ups; registering your interest on our website does not create an account or Subscription. When accounts open, new sign-ups may receive a 5-day free trial with no card required, subject to Ofsted registration verification. After the trial, billing follows the plan and interval you select.
6.2 Fees and tax
Subscriptions are billed in GBP monthly or annually (annual plans include a 10% discount vs twelve monthly payments). Peekaboo HQ is not currently VAT-registered, so no VAT is charged on any plan. If we become VAT-registered in future, we will tell you at least 30 days before VAT applies to your next renewal. We may change prices with at least 30 days' notice before the change applies to your next renewal.
6.3 Cancellation and refunds
You may cancel a paid Subscription at any time in account settings or by contacting us. Cancellation takes effect at the end of the current paid billing period unless otherwise agreed. We do not generally prorate refunds for unused time on monthly plans after the period starts.
For annual plans purchased as a business, fees are generally non-refundable for the paid term once the period has started, except where we are required to refund by law or we agree otherwise in writing.
Consumers: If you are a consumer buying at a distance, you may have a 14-day cooling-off right under the Consumer Contracts Regulations 2013. If you ask us to start the Service during that period, you may lose the right to cancel for services already performed, and we may charge a reasonable amount for them. Nothing in these Terms excludes your statutory rights under the Consumer Rights Act 2015.
7. Customer Content and data protection
You retain ownership of Customer Content. You grant Peekaboo a worldwide, non-exclusive licence to host, process, transmit, and display Customer Content solely to provide and secure the Service, and as otherwise described in the Privacy Policy and any Data Processing Addendum (DPA).
For child, parent, and staff records you upload, you are typically the controller and Peekaboo is your processor. You must have a lawful basis (and Article 9 condition for special category data such as medical information) and provide required privacy information to individuals. Our processing is described in the Privacy Policy and DPA.
You must not upload Customer Content unlawfully, or content you do not have rights to use.
8. Acceptable use
You agree not to:
- Use the Service for unlawful, harmful, fraudulent, or abusive purposes
- Harass, threaten, or discriminate against others via the Service
- Upload illegal content, including illegal images or content that exploits children
- Share login credentials except with authorised users in your organisation
- Attempt to access other customers' data or bypass security controls
- Probe, scan, or reverse engineer the Service except as allowed by law
- Use bots, scrapers, or automated means to extract data except via documented APIs we enable for your plan
- Overload or disrupt the Service, or circumvent rate limits
- Misrepresent your identity or affiliation
- Use the Service to store data unrelated to legitimate childcare operations on your plan
9. User-generated content, moderation, and reporting
Messages, photos, and documents you share may be visible to authorised staff and invited parents according to your configuration. We may remove or disable access to content that we reasonably believe breaches these Terms or applicable law, and we may suspend accounts involved.
To report illegal or abusive content, or a safeguarding concern related to content on Peekaboo, email legal@peekaboohq.com with details and URLs/IDs where possible. We will review reports in a timeframe appropriate to the risk. This does not replace your duty to follow local safeguarding procedures and report to authorities where required.
10. Intellectual property
The Service, software, branding, and documentation are owned by Peekaboo or its licensors. Your Subscription grants a limited, non-exclusive, non-transferable licence to use the Service for your internal childcare operations during the Subscription term. Feedback you provide may be used by us without obligation to you.
11. Third-party services
The Service may integrate with third parties (for example payment providers). Their terms and privacy notices apply to their services. We are not responsible for third-party services we do not control.
12. Availability
We aim for high availability (including a non-binding target of 99.9% uptime for core production services) but do not guarantee uninterrupted Service unless a separate written SLA says otherwise. We may perform maintenance. We are not liable for delays or failures caused by events beyond our reasonable control.
13. Warranties and disclaimers
We will provide the Service with reasonable care and skill. Except as required by law, the Service is provided otherwise on an "as available" basis, and we do not warrant that it will be error-free or meet every regulatory outcome for your setting.
Nothing in these Terms excludes or limits liability that cannot be excluded under English law, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or your non-excludable statutory rights as a consumer.
14. Limitation of liability
Subject to section 13, we are not liable for loss of profits, revenue, goodwill, or indirect or consequential loss, whether arising in contract, tort (including negligence), or otherwise, except where such limitation is not permitted by law.
Subject to section 13, our total aggregate liability arising out of or in connection with the Service in any 12-month period is limited to the greater of (a) the fees you paid us for the Service in that period, and (b) £100.
15. Suspension and termination
You may stop using the Service and cancel as described in section 6. We may suspend or terminate access for material breach, illegal activity, non-payment, or risk to the Service or other users, with notice where reasonable and lawful. On termination, your licence ends. Customer Content handling after termination follows the Privacy Policy and DPA.
16. Changes to these Terms
We may update these Terms. Material changes will be notified by email or in-product notice at least 30 days before they take effect where practicable. If you do not agree, you should cancel before the effective date. Continued use after the effective date constitutes acceptance, except where acceptance must be express by law.
17. Governing law and disputes
These Terms are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction, except that if you are a consumer you may bring proceedings in your local UK courts, and mandatory consumer protections in your place of residence still apply.
